Welcome to Gulf Coast SkySpectra. These Terms of Service ("Terms") govern your use of our website located at gulfcoastskyspectra.com (the "Site") and the drone light show services we provide ("Services"). By accessing our Site or using our Services, you agree to be bound by these Terms.

Please read these Terms carefully before using our Site or Services. If you do not agree to these Terms, you may not access or use the Site or Services.

By accessing or using our Site, you represent that you are at least 18 years old and have the legal capacity to enter into these Terms. If you are using our Services on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to the Site. Your continued use of the Site or Services after any changes constitutes your acceptance of the new Terms.

Gulf Coast SkySpectra provides professional drone light show entertainment services, including but not limited to:

• Custom drone light show design and choreography
• FAA-compliant drone fleet operations
• Event consultation and planning
• On-site show execution and management
• Pre-show simulations and previews
• Music synchronization services

All drone operations are conducted in compliance with Federal Aviation Administration (FAA) regulations, including Part 107 certification and applicable waivers for night operations and multi-aircraft coordination.

Quote Requests

Submitting a quote request through our Site does not constitute a binding agreement. All quotes are estimates based on the information provided and are subject to change based on final event details, venue requirements, and regulatory considerations.

Booking Confirmation

A booking is confirmed only upon execution of a separate written service agreement and receipt of any required deposit. The service agreement will contain specific terms regarding pricing, payment schedules, cancellation policies, and event-specific requirements.

Pricing

All prices quoted are in U.S. dollars and are subject to applicable taxes. Pricing may vary based on factors including but not limited to: fleet size, show duration, venue location, complexity of designs, and regulatory requirements.

When using our Site or Services, you agree to:

• Provide accurate and complete information in all communications and quote requests
• Obtain all necessary permissions and permits for your event venue
• Comply with all applicable local, state, and federal laws
• Not interfere with or disrupt our Site or Services
• Not use our Site for any unlawful purpose
• Not attempt to gain unauthorized access to any portion of the Site
• Not reproduce, duplicate, copy, sell, or exploit any portion of the Site without express written permission

Client Cancellation

Cancellation terms are specified in individual service agreements. Generally, cancellations made more than 30 days before the event may be eligible for a partial refund. Cancellations made within 30 days of the event may result in forfeiture of deposits.

Weather-Related Postponements

Drone operations are weather-dependent. In the event of unsafe weather conditions (including but not limited to high winds, rain, lightning, or low visibility), we reserve the right to postpone or cancel the show for safety reasons. Weather-related postponements will be handled according to the terms specified in your service agreement, which typically includes provisions for rescheduling at no additional cost.

You may not use our Site or Services:

• For any illegal or unauthorized purpose
• To violate any laws in your jurisdiction
• To infringe upon or violate our intellectual property rights or those of others
• To harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate
• To submit false or misleading information
• To upload or transmit viruses or any other type of malicious code
• To collect or track the personal information of others
• To spam, phish, pharm, pretext, spider, crawl, or scrape
• For any obscene or immoral purpose
• To interfere with or circumvent the security features of the Site

7. Intellectual Property

The Site and its original content, features, and functionality are owned by Gulf Coast SkySpectra and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

Our trademarks, service marks, and logos may not be used in connection with any product or service without our prior written consent.

Show designs, choreography, and custom animations created for clients remain the intellectual property of Gulf Coast SkySpectra unless otherwise specified in a written agreement.

8. Media and Content Rights

By engaging our Services, you grant Gulf Coast SkySpectra the right to photograph and record our drone shows for promotional purposes, unless otherwise specified in writing. This includes the right to use such media on our website, social media channels, and marketing materials.

If you require exclusive media rights or wish to restrict our use of event footage, please discuss this with us prior to booking and include such terms in your service agreement.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GULF COAST SKYSPECTRA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your access to or use of or inability to access or use the Site or Services
• Any conduct or content of any third party on the Site
• Any content obtained from the Site
• Unauthorized access, use, or alteration of your transmissions or content
• Weather-related cancellations or postponements
• Regulatory restrictions or airspace limitations

Our total liability for any claims arising out of or relating to these Terms or our Services shall not exceed the amount you paid us for the Services in question.

10. Disclaimer of Warranties

THE SITE AND SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Site will be uninterrupted, timely, secure, or error-free, or that any defects will be corrected. We do not warrant that the results obtained from the use of the Site or Services will be accurate or reliable.

11. Indemnification

You agree to defend, indemnify, and hold harmless Gulf Coast SkySpectra and its officers, directors, employees, contractors, agents, licensors, and suppliers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Site or Services.

12. Insurance

Gulf Coast SkySpectra maintains comprehensive liability insurance coverage of up to $5 million for all drone operations. Certificates of insurance can be provided upon request and may be required by certain venues or event organizers.

Additional insured status may be available for clients upon request, subject to approval by our insurance provider.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any legal action or proceeding arising out of or relating to these Terms shall be brought exclusively in the state or federal courts located in Hidalgo County, Texas.

14. Dispute Resolution

Any dispute arising from these Terms or your use of our Site or Services shall first be attempted to be resolved through good-faith negotiation between the parties. If the dispute cannot be resolved through negotiation within 30 days, either party may pursue binding arbitration or litigation as provided in these Terms.

15. Severability

If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced to the fullest extent under law. The failure of either party to enforce any right or provision of these Terms will not be considered a waiver of such right or provision.

16. Entire Agreement

These Terms, together with our Privacy Policy and any service agreements you may enter into with us, constitute the entire agreement between you and Gulf Coast SkySpectra regarding your use of the Site and Services, superseding any prior agreements between you and Gulf Coast SkySpectra.
